The trade union federation in healthcare „Solidaritatea Sanitara” supports the principle of performance-based bonuses in the medical field but considers that the form proposed by the Ministry of Health is erroneous.
„The „Solidaritatea Sanitara” federation of Romania (FSSR) supports the principle of performance-based bonuses in the medical field, this being a request constantly addressed to all governments in recent decades. Support for this principle is also demonstrated by the draft of the new salary law, developed together with the representatives of the Ministry of Health and those of the other representative social dialogue partners at the health sector level, which includes an important dimension of additional remuneration based on performance, targeting all categories of healthcare employees. The federation does not support the draft law launched for public debate by the Ministry of Health these days because it was developed in flagrant violation of the legal and contractual provisions on remuneration and does not meet the minimum conditions of the principle of performance-based bonuses,” reads a press release of the federation on Tuesday.
According to the same source, from the perspective of formal requirements, the procedure used by the Ministry of Health in the development of this draft law violates the rules of social dialogue, a series of legal provisions and express and imperative provisions of the collective labour contract.
„The federation did not participate in any negotiations on this legislative initiative, which makes it voidable from the perspective of the violation of express legal and contractual provisions,” the press release also states.
According to the same source, the trade union federation initiated a working group to develop an alternative draft normative act, which would respect the principles of performance-based bonuses and be coherent with the normative acts in force.
„Given the intention of the Ministry of Health to use a series of additional professional criteria in evaluating performance compared to those specific to the salary legislation, we consider relevant the expertise of professional bodies in the field of selecting these categories of additional criteria and their evaluation procedures. To this end, the „federation publicly invites professional bodies to a joint action, aimed at generating a performance evaluation system based on relevant criteria and objective procedures, which should be the reference in the matter of performance-based bonuses,” the press release states.
